Terms of Service

These Terms of Service (“Terms”) govern your use of Music Bingo IQ (the “Service”), operated by an individual sole proprietor doing business as Music Bingo IQ (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. What the Service does

Music Bingo IQ is a tool that lets hosts run music bingo and trivia games. Hosts build playlists, optionally generate fun facts and trivia using AI, create bingo cards, and run live games that players join from their own devices. Players do not need an account; they join a host's game using a room code or QR code.

2. Accounts

To host games you must create an account with a valid email address. You are responsible for keeping your login secure and for all activity under your account. You must be at least 18 years old, or the age of majority in your jurisdiction, to create a host account.

3. Subscriptions, billing, and cancellation

The Service is offered on monthly subscription plans (currently Starter, Pro, and Venue) at the prices shown on our pricing page. Payments are processed by Stripe; by subscribing, you also agree to Stripe's terms. Subscriptions renew automatically each month until cancelled.

4. Your music and content — and licensing responsibility

The Service plays audio files from your own device; we do not host, upload, or provide music. You are solely responsible for the music you use and for obtaining any licenses, permissions, or rights required to play that music publicly — for example, performance licenses that may be required for play in a bar, restaurant, venue, or other public setting. You represent that you have all rights necessary to use your content with the Service, and you agree that we are not responsible for your music licensing or public-performance obligations.

5. AI-generated content

The Service can generate fun facts and trivia using AI. AI output may be inaccurate, incomplete, or outdated. We provide tools for you to review and edit all generated content, and you are responsible for reviewing it before using it in a live game. We make no warranty that AI-generated facts or trivia are accurate or fit for any particular purpose.

We may suspend or terminate accounts that violate these Terms.

7. Service availability

We work to keep the Service running but provide it “as is” and “as available,” without guarantees of uptime, uninterrupted access, or that it will be error-free. We may modify, suspend, or discontinue parts of the Service at any time.

8. Disclaimers and limitation of liability

To the fullest extent permitted by law, the Service is provided without warranties of any kind, express or implied. We are not liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your content or music, or your violation of these Terms or any law or third-party right — including any music-licensing or public-performance claims related to the music you choose to play.

10. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Effective” date above. Material changes will be communicated where reasonable. Continued use of the Service after changes take effect means you accept the updated Terms.
